The Indore bench of Madhya Pradesh high court on Friday quashed a criminal proceedings of fraud at Nagda sessions court after it observed that the case was of a civil nature and the criminal proceeding was launched with the ‘oblique motive to exert pressure’ on the petitioner.

The order was passed by Justice Virendra Singh who made strong observations on the maintainability of the case under sections regarding fraud and cheating.

Comex Infratech had been awarded a contract for building a road in Nagda, which was sublet to Golden Anushree Highways and the two parties entered into a contract for the construction of the road. As a security deposit, Comex Infratech gave post dated cheque of Rs 48 lakh to Golden Anushree Highways with the understanding that the cheque were not meant to be encashed,” advocate Raghvendra Singh Raghuwanshi said. However, the main cont-ractor company was black-listed before the work could be completed, due to which the contract between Comex Infratech and Golden Anushree Highways termi-nated. The petitioner corn-
